Abstrakt: | The author presents the lessons he learned from the U.S. Supreme Court's sentencing opinions in Apprendi, Blakely, Booker, Rita, Kimbrough and Gall. The author believes that a judge must never impose a sentence that is too harsh or too lenient. The author claims that sentencing judges can be divided into two groups--those who are damn sure they are right and those who have no idea. |
