Abstrakt: | The article discusses the court case Kelly versus State in which the defendant Francesco Kelly appealed against a trial court decision to prevent his two witnesses from testifying in his attempted murder and assault case at the Maryland Court of Appeals. The three people whom he had dispute with in a bus had identified him as the one who shot them. The trial court excluded the witnesses based on the defense counsel's proffers. The appeals court ruled that trial judge violated the Sixth Amendment right of Kelly by preventing him from presenting a defense. |
