Abstrakt: This article focuses on sharikah, a form of classical Islamic contract that is presently used and implemented by Islamic private equity transactions. It explains that there are several issues that arise from Islamic private equity transaction because of the interaction between the legal regime in the U.S. and other non-Muslim countries, and the requirement of Shari'ah law. It highlights a transaction between an Islamic investment bank acquiring a non-controlling share in a U.S. company. It says that this transaction demonstrates the increasing ability of Islamic finance to implement the substantive precepts of Shari'ah in non-Muslim countries such as the U.S.
