The article examines the issues of trade and environment, based on ruling of the European Court of Justice (ECJ) in the case of Chemische Afvalstoffen Dusseldorp BV and Others v. Minister van Volkshuisvesting, Ruimtelijke Ordening en Milieubeheer, which was issued on June 25, 1998. In this case, the ECJ upheld the principles of proximity and self-sufficiency do not apply to waste for recovery but only to waste for disposal. The ECJ also opens the possibility of limiting competition in accordance with Article 86(2) (ex 90(2)) of the European Community Treaty. |
