Abstrakt: The article identifies the appropriate standard of review for specific civil, family law, administrative as well as criminal matters in the U.S. The author points out that decisions that fails to admit mitigating evidence are reviewed under the harmless error standard and affirmed if found to be harmless beyond a reasonable doubt. He also mentions that determining whether the violation of probation is willful and substantial is a factual question that is left to the trial court.
