Abstrakt: The article presents an analysis of the decision of the 11th Circuit Court of Appeals in "Amlong and Amlong, P.A. v. Denny's, Inc.," on the application of court sanctions against lawyers who pursue frivolous claims in behalf of their clients under 28 United States Code Section 1927. The majority opinion held that objectively reckless conduct in the pursuit of a frivolous claim is sufficient to warrant sanctions although the lawyer does not act malevolently and knowingly.
