Abstrakt: Federal immigration law provides for a 60-day deadline for voluntary departure. Petitioner sought to appeal his departure and did so—pursuant to an immigration judge’s order—on the next business day, which was a Monday. This was technically too late under the 60-day rule. Petitioner argues that historically immigration courts and others have applied the common-law rule that extends deadlines that run on weekend days to the next business day. The Supreme Court will have to determine whether the voluntary departure period of 60 days means 60 days, even if it falls on a weekend day. [ABSTRACT FROM AUTHOR]
