Workplace Artificial Intelligence Regulation in China: Between Efficiency and Social Stability.

Abstrakt: China has made significant advancements in artificial intelligence (AI) research and commercialization, particularly in speech and image recognition. This has led to the growth of the gig economy in China, with around 200 million workers in new forms of employment like food delivery and ride-hailing. China has implemented regulations on algorithms and platform work to balance efficiency and social stability, but the focus on economic growth over labor protection leaves workers vulnerable. The regulations cover areas such as talent, employment flexibility, labor standards, employee voice, and trade union initiatives, aiming to enhance AI development, protect workers' rights, and address concerns about social stability. However, enforcement has been weak, and the regulations may be more about containing labor unrest than protecting workers. The All-China Federation of Trade Unions (ACFTU) plays a role in platform labor regulation but is limited in its effectiveness due to the tight control of the Party-State. Journalists, researchers, and the public have been crucial in advocating for labor-friendly regulations. Overall, China's approach to AI workplace regulation balances efficiency with social stability but exposes workers to the challenges of techno-capitalism under an authoritarian regime, and the long-term effectiveness of these regulations remains uncertain.
