The article explores legal and regulatory burdens that per- and polyfluoroalkyl substances (PFAS) contamination can present in industrial/commercial real property transactions. Topics discussed include PFAS usage in industrial and consumer manufacturing and products, PFAS regulations such as the National Primary Drinking Water Regulation, Resource Conservation and Recovery Act and Comprehensive Environmental Response, Compensation and Liability Act, and liability risk management strategies. |
