Abstrakt: Professor Gerald S. Dickinson's article, "The Fourth Amendment's Constitutional Home," explores the discrepancy between the special treatment of one's home under most of the Bill of Rights and the undifferentiated treatment of domiciles under the takings clause. Dickinson reviews the protections given to the home under the First, Second, Third, and Fourth Amendments, as well as the criminal procedure clauses of the Fifth Amendment. He examines various exceptions to the warrant requirement for searches and seizures of homes and offers potential explanations for the weakening of home protections under the Fourth Amendment. Dickinson's article provides a comprehensive discussion of homebound rights and offers insights into theories of constitutional interpretation. [Extracted from the article]
