Abstrakt: This article discusses the constitutional protection of minority groups in Italy, with a specific focus on the ladin minority in the autonomous provinces of Bolzano/Bozen and Trento. It examines the role of the constitutional court in expanding institutional representation and participation in power-sharing for these minorities. A key point of discussion is the direct appeal process ("Direktantrag") available to language groups in the Trentino-South Tyrol region, which represents a unique aspect of minority rights within Italy's legal framework. The article analyses specific court rulings that address the balance between minority protections and broader legal principles, including the constitutional compatibility of laws affecting minority interests. The author delves into the implications of such rulings for the legal subjectivity of minority groups, which, despite being minimally invoked in practice, serves as an important area for academic debate and development within the context of minority protections in Italy.
