This article explores the issue of racial bias in jury selection and its impact on fair trials. Drawing on research from the Capital Jury Project, the authors highlight how the racial composition of the jury and the race of the defendant and victim can influence sentencing outcomes. The study reveals that white jurors often exhibit less empathy towards Black defendants and their families, leading to biased perceptions and judgments. The article suggests strategies to address racial bias, such as using pretrial questionnaires and implicit bias training, and provides definitions of different forms of racism to assess prospective jurors' racial attitudes. It also emphasizes the importance of engaging jurors in conversations about their racial attitudes during voir dire to ensure a fair trial. [Extracted from the article] |
