Many states worldwide, including Republic of North Macedonia, have incorporated in their legislations medical-pharmacological treatment a.k.a. chemical castration as a criminal sanction for child sexual abusers. Chemical castration is a type of hormone therapy that takes away the offender's sexual desire. There can be some unpleasant side effects, but they are mostly reversible and this paper tries to argue that this procedure is humane and necessary to prevent child molesters specifically pedophiles. However, the application of chemical castration to child sexual abusers undoubtedly raises many issues, both moral and legal. The main issue raised in the academic and scientific circle is the issue of human rights respectively in this case violation of certain rights of the perpetrator of these crimes by the fact of the implementation of chemical castration procedure against him. In order to understand whether chemical castration violates or not the basic human rights of the perpetrator, the author in this article will try to answer three questions, mainly raised by scientists in this matter: First, Is chemical castration a torture, denigrating and inhuman punishment? Second, does chemical castration deny the right of private life and the right to procreate? And finally, does the chemical castration deny the right to dignity and integrity?. [ABSTRACT FROM AUTHOR] |
