Vladymyrsky-Budanov`s one of the founders of the Western law (Lithuanian-Ruthenian) studies school that appeared on the verge of XIX - early XX century at the St. Vladimir Kyiv University. The article is dedicated to the examination M. F. Vladymyrsky-Budanov`s scientific biography and scientific activity associated with the Magdeburg (German) law in the city management problem. The article discusses M. F. Vladimir-Budanov`s one of the important scientific topics - the urban law (Magdeburg) in the Right-bank Ukraine and Galicia cities establishment and formation. This topic was one of the first in the scientific career and the scientist`s work. It was the basis of his PhD thesis defended at the St. Vladimir Kyiv University. The article discusses the content of the M. F. Vladimirsky-Budanov`s work main provisions submitted to the defense as well as the assessments which this work received among modern authors of scientists. In particular V. S. Ikonnikov determined M. F. Vladimirsky-Budanov actually for the first time took up the development of an unexplored problem of law in the cities of Ukraine during the XV-XVI-XVII centuries period. The M. F. Vladimirsky-Budanov’s conclusions influenced V. B. Antonovich`s the famous founder of the populist direction in the Ukrainian historiography further research in this direction and his similar to M. F. Vladimirsky-Budanov’s work`s appearance. In addition, the M. F. Vladimir-Budanov`s conclusions in this field actually entrenched the ukrainian national historiography for many years in this field. M. F. Vladymyrsky-Budanov`s content was that German law (Magdeburg) distorted the Slavic organization in the management of Rus cities. This conclusion drew the first critic of the M. F. Vladymyrsky-Budanov`s work V. S. Ikonnikov`s attention, acknowledging that at the time of the introduction of the Magdeburg law, slavic law failed to codify and regulate urban life. It`s necessary to mark that M. F. Vladimirsky-Budanov`s division of cities - with full Magdeburg law, incomplete Magdeburg law and private-ownership cities was reflected in the further researchings. M. F. Vladymyrsky-Budanov`s about the Magdeburg Law negative conclusions included thesis about the cities ruled a limited number of people, who took finances and abused them. This caused numerous - international conflicts in the Kamenetz – Podolsky, Lviv cities between armenians, jews, ukrainians (rusyns) germans. These negative assessments associated with the Magdeburg Law introduction, were also developed in further studies of urban self-government of Ukrainian cities. At the same time, it was M. F. Vladimirsky-Budanov`s, despite the critical overall assessment of the Magdeburg Law. M. F. Vladimirsky-Budanov almost was the first time admitted that unite in the fraternity was within the framework of the Rusyns`s organization that became possible. This contributed the Ukrainian national consciousness development in the cities. The article considers that in V. B. Antonovich (the M. F. Vladimirsky-Budanov`s works follower) came to similar conclusions about the Magdeburg law in the Ukrainian cities life. V. B. Antonovich noted that the Magdeburg Law introduction was an attempt to save the city organization from the threat of turning few Ukrainian cities into villages in the XV-XVI centuries. Thus M. F. Vladimirsky-Budanov`s vision of the role of the Magdeburg law in the development of Ukrainian cities gave a start not only medieval Ukraine urban life researchings, but also the discussion about negative consequences of the (Magdeburg) German law in Ukrainian cities main causes in which the further researchers’ of this problem differed about the matter The article present`s the modern Ukrainian historical science attitude to the negative assessment of the Magdeburg law in Ukrainian medieval cities in which (historiography) is characterized by a complete rejection of the unambiguous M. F. Vladimirsky-Budanov`s negative assessment to the Magdeburg law in Ukrainian cities. [ABSTRACT FROM AUTHOR] |
