Consumers or simple individuals may become overindebted and end up in financial difficulty. Within the forms of the procedure applicable to the insolvency of individuals, Law no. 151/2015 also regulates the simplified procedure. This procedure applies to debtors who do not have traceable assets or income, have obligations of no more than 10 minimum wages pereconomy and areabove the standard retirement age or have lost all or at least half of their working capacity. The simplified insolvency procedure of the individual is opened by the court at the request of the debtor addressed to the insolvency commission which then, as the case may be, notifies the court. The opening of the simplified procedure has the following effects: the legal suspension of all enforcement measures for the proceeding of claims on the debtor's patrimony; legalsuspension of theflow of debtaccessories;suspension of the prescription of the creditor's right to demand the enforcement of claims against the debtor.
