Although dressed up as an interpretive rule for the FTC's own regulation, the FTC's Policy Statement in fact announced a new statutory interpretation that should be subject to the APA's notice and comment requirements. Now that the FTC is purportedly filling this gap through the issuance of the Policy Statement, many entities who had not been considered subject to either HIPAA or the Rule may now face FTC enforcement under the Rule. On September 15, 2021, the Federal Trade Commission issued a controversial Policy Statement1 (the Policy Statement) claiming to clarify the scope of the Health Breach Notification Rule2 (the "Rule"), with the intent of significantly expanding the FTC's enforcement power in the area of digital health.
