| Abstrakt: |
The article explains the concept of public policy exception and refusal of recognition and enforcement of foreign arbitral awards in Brazil. It discusses the major doctrine in domestic public policy, international public policy and transnational public policy. The perspectives of the Brazilian judiciary on public policy in international arbitration are explored. It mentions the basis of refusal of an arbitral award under the New York Convention in which Brazil is a member-state. |
