Abstrakt: |
The average South African workplace is a melting pot for race, ethnicity, gender, and culture. This diverse workplace needs to be managed so that none of the employees feels discriminated against or prejudiced in any way. For this reason, the Constitution of the Republic of South Africa, 1996 (hereafter referred to as the Constitution, 1996) and subordinate legislation outlaws all forms of discrimination in and outside the workplace. The promulgation of legislation alone is no guarantee that there will not be discrimination; hence, this article assesses the effectiveness of legislation implementation. The results show that the department needs to intensify its efforts to ensure that discrimination of any kind is prevented and that employees are aware of legislation meant to protect them and procedures which need to be followed.
