The article offers information on the decision of U.S. Supreme Court in the case Mission Product Holdings Inc. v Tempnology LLC. Topics discussed include rejection of an executory contract by concluding that rejection in bankruptcy cases breaches the agreement but does not rescind the entire contract; Tempnology could reject and rescind the agreement, which terminated Mission's rights to use the Coolcore trademarks; and effects and consequences of rejection under Section 365. |
