Abstrakt: The report of U.S. Senator on the reign of martial law in the West Virginia coal strike confirms the main contention of those who brought about the Congressional investigation. With the civil courts in full operation, and without evidence that the popular bitterness would impair their function, the military authorities arrested, sentenced, and punished men in violation of the Constitution of the State and the nation. Even arrests made outside the zone of martial law resulted in military trial. Worst of all, penalties in excess of those permitted by law were imposed on the arbitrary ground that public intimidation was demanded.
