The right of private property has been one of the fundamental rights known since the ancient antiquity. The rights of individual ownership were first treated in the philosophical ideas of Russeau, Lock, Hobbes and other philosophers who focued on private property. The institutionalization of this particular right coincides with its formalization in various important legal documents. The Republic of Albania has treated the private property in various forms, depending on the political systems, which, throughout history, can be found in various forms including the following: an empire during the period of the Ottoman occupation, a monarchy, in the form of a communist totalitarian regime, and eventually that of a democratic society. The institution of property in Albania, as well as the whole judicial system is based on the Roman-German system (civil law), which is the major source of the right. The European Union, along with its mechanisms and institutions is playing a primary role in the solution of the problems that have to do with the private property in the Republic of Albania. The commonalities that all political systems have with regard to private property have to be found in the most important legal documents such as charters, constitutions and laws regarding the fundamental rights and freedom of individuals.
