The article examines the origin of the separability doctrine in the U.S. Supreme Court's own jurisprudence, as well as the ruling of the Sixth Circuit on the case, Star Athletica, LLC v. Varsity Brands, Inc., which concerns the copyrightability of two-dimensional graphic designs printed on the fabric of cheerleading uniforms. Topics discussed include information on the case Mazer v. Stein, and how the court distinguishes the critical distinction between garment design and fabric design. |
