Abstrakt: The article discusses the 1861 American case Ex parte Merryman (Merryman) which deals with the scope of lawful military authority during war time, and it mentions a battle between then-U.S. President Abraham Lincoln and American Supreme Court Chief Justice Roger Brooke Taney during the nation's Civil War, as well as various myths regarding the Merryman case. Suspected militia group member John Merryman's habeas corpus proceeding is assessed, along with Lincoln's power to suspend habeas corpus.
