The enforcement of environmental liabilities in Brazil has dramatically increased over the past few years, with decisions to pierce the corporate veil regardless of fault and the imposition of sanctions or the payment of damages against managers. In turn, the number of judicial reorganisations in the country has never been higher.This article analyses the intersection of these two phenomena, elaborating on measures to minimise environmental risks in restructuring transactions.
