Abstrakt: The article discusses the Leahy-Smith America Invents Act (AIA), the history of U.S. patent law and patent law reform efforts, and the patentability of the commercial use of a trade secret. Topics include acquisition of the rights to a patent by the first inventor to file (FITF) rather than the first inventor to make the invention under the AIA, its impact on priority among inventors and the nature of the applicable prior art, and issues in secret commercial use and the forfeiture doctrine.
