| Abstrakt: | The article discusses the question of whether the state of New York should punish those individuals who knowingly transmit the HIV virus to others as of 2014, and it addresses whether the administration of the HIV virus in an out-of-body form to another person qualifies for dangerous instrument treatment under New York State Penal Law. Criminal liability and New York's judge-made law standards are examined, as well as statutory punishments and several New York legal cases. |
