In this article, the authors discusses the important factors that might give rise to a claim of undue influence and also provide suggestions to enhance enforceability of estate-planning documents and recommend tips for litigating undue influence cases. Topics discussed include presumption of undue influence, American Bar Association (ABA) Model Rules of Professional Conduct provide guidance for ethical duties and individual's testamentary capacity and vulnerability to undue influence. |
