Abstrakt: The article focuses on the importance of tiered constitutional scrutiny with reference to several court cases. Topics discussed include the tiered scrutiny involved in adjudication addressing equal protection, freedom of speech and the free exercise of religion as well as substantive due process, judicial discretion manipulability issues surrounding the tiered scrutiny and the U.S Supreme Court's decision in equal protection case of Sugarman v. Dougall.
