Abstract: The development of the criminal procedure in Slovak Republic and Czech Republic brought many changes in last hundred years.One of them was the substitution of the principle of material truth by the standard of proof beyond a reasonable doubt. This article deals with the aim of the principle of material truth for the criminal procedure in the past, reasons of leaving this principle and its substitution by the standard of proof beyond a reasonable doubt as well.Moreover the article presents the aim of the standard for the criminal procedure in present day. The term of ‘reasonable doubt’ is the crucial one for the practical application of this standard in the criminal procedure; therefore the article pays attention to the interpretation of this term. The American courts have been already interpreting it with the contemporary meaning from the half of the 19th century, and that is the reason, why it is interpreted in this article in connection with the selected decisions of the American courts. |
