The U.S. Supreme Court recently settled a conflict between federal courts regarding the level of harm an employee must show in cases of internal job transfer discrimination. The Court ruled that an employee only needs to show some harm from a forced job transfer to maintain a Title VII discrimination lawsuit, rejecting the requirement of "material" or "significant" harm. This decision will have a significant impact on employee challenges to internal job transfers based on protected status. Employers should carefully review internal transfer requests and train supervisors and managers to ensure that transfers are not based on an employee's protected status.
