Abstrakt: |
The article discusses the liability of the generator, transporter and disposer of hazardous substance under the Federal and the California superfunds. It is stated that the social institutions of the country have begun to recognize the full impact of the problems and costs attendant to the storage, transportation and treatment of hazardous substances. The Federal Comprehensive Environmental Responses, Compensation and Liability Act of 1980 are both designed to provide a fund for the cleanup of hazardous substances. Meanwhile, the state act establishes a Hazardous Substance Account to be administered by the director of the State Department of Health Services. |
