Abstrakt: The Tribunal Constitucional has issued a ruling on the Andalusian Law on Territorial and Urban Planning (LISTA), which deals with urban planning in Andalusia, Spain. The court rejected several claims against the law, stating that they did not hinder the legislative process. However, the court did find certain provisions of the law to be unconstitutional, including a comment allowing residential construction in rural areas and the exclusion of mining activities from municipal urban planning permits. The court also clarified that certain uses, such as renewable energy and mining, can be considered ordinary in non-protected rural areas.
