| Popis: | 107 On both sides of the strait become the respective application of their law because the government of the Republic of China had moved to Taiwan in 1949. Up to now, this situation has been seventy years. And with the evolution of society in the past 70 years, the laws have become very different on both sides of the strait, that was after the laws has undergone several amendments. In 1987, Taiwanese people be allowed to go back to the mainland to meet their family, with the opening of the policy. And the increasing exchanges between the two sides of the strait. Therefore, the number of cross-strait marriages has also increased. However, the divorce rate is still high in today's society, so there are a lot of people are faced with the problem of divorce. This article will introduce the divorce system on both sides of the strait. At first, introduce the institution of the law of divorce from a historical. Next, study and compare the current regulations of divorce, including the way of divorce, the personal status of force of law, the property of force of law, and applicable the law of divorce, between the two sides of the strait. Finally, by study the institution of the law of divorce on both sides of the strait; then compare and understand the differences and find out their strengths and weaknesses. The strengths can be used for revisions in the future. |
