| Popis: | 96 Ancestral Estates will become a right master after conducting “Statute For Ancestral Estates In Joint Ownership”. But its states of be a right master will be different from legal foundation and corporation juridical person. There will be a problem that could Ancestral Estates be a right master obeys the relative rule of “Civil Law” if “Statute For Ancestral Estates In Joint Ownership” wouldn’t mention these rule. The purpose of this study was to explore the lack of the “Statute For Ancestral Estates In Joint Ownership” and the satisfying degree of the staffs of Ancestral Estates to the Statute by observing the operation and legal system of Ancestral Estates, the explanation, legal precedent and resolution of Judiciary, some conclusions of symposium and the researches of experts, and by interviewing the staffs of Ancestral Estates. The conclusion was that legislating a new law like “Statute For Ancestral Estates In Joint Ownership” is necessary for the management, sale and using of Ancestral Estates. The conducting of “Statute For Ancestral Estates In Joint Ownership” will be positive to manage Ancestral Estates. The only lack is that “Statute For Ancestral Estates In Joint Ownership” will interfere the operation and management of Ancestral Estates too deep, which against the principle of private autonomy. |
