Popis: | 94 This dissertation is based on the concept of human dignity and aim at discussing the feasibility of euthanasia as well as verifying its justification both in medical ethics and legislation. The study would try to continually analyze and understand the meaning and content of human dignity pursuant to the theories of historic philosophers and great thinkers as well as each country’s practical legislative system so as to induct three axioms of human dignity, such as end-in-itself, the formula of autonomy and the ceiling price value. Then explore the nature of death and define euthanasia alleged in this thesis in terms of “executed by others” which is divided into two styles of “voluntary” and “non-voluntary” and use 2 theories of double effects & active and passive obligation to illuminate how difficult to execute euthanasia in decision-making. In the end, this thesis would apply the three axioms of human dignity to examine whether human dignity is considered in the existent legislation of Taiwan for euthanasia. The author found that the ethics approach of euthanasia has contained the axiom that means the dignity of life can be inferred into the dignity of death, then we can say that euthanasia conform to human dignity. The justification of non-voluntary euthanasia has been controversial, but people often seek for euthanasia due to some actual requests and its execution is always based on the extension of dignity for dying which the author has positively affirmed. |
