| Popis: | 93 The effort was inefficiency in negotiating opposite opinions due to the lack of case study and systematic procedure at both sides. It was only based on the judgment of possible reaction at different party, and the shortcoming was therefore been unattended. This paper would focus on the systematic procedure which will help on both client and the contractor in court during the period of the execution of the contract. Past studies were on the statement of the argument at both sides, and were not on the insisting requests. It may not reflect the truth in those cases. The sentences of the construction controversy in Taipei District Court were studied and analyzed. It results the 11-problem-related and 8-solution-related on the sentences which can be used as the data base for the controversy on the contract execution in construction area. It was categorized on both fact statement and request, and was not on the disagreement on both sides. This study also utilizes the concepts of set, multiple choices of the indices, therefore improve the shortage of the fix index on traditional cases. In except to the fact statement, the concept of law was included in plea and evidence. It is close to the truth and can give information effectively. |
