The author analyses the provision of Article 100 of the Executive Penal Code in terms of its compliance with the standard set out in Article 8 of the European Convention on Human Rights from the perspective of a convict’s right to maintain direct contact with their relatives. The basis for this are the grounds for the ECtHR ruling in the case of Polyakova and Others v. Russia (7 March 2017), in which the Court constructed a model for testing whether state interferences in the convicts’ right to respect for their family life comply with the standard enshrined in the Convention. |
