| Popis: | Neste trabalho, analisou-se o papel do Tribunal de Contas - TCU como órgão de controle externo das atividades mineradoras reguladas pela ANM, estudando o setor mineral brasileiro, através da lente da accountability horizontal para compreender a atividade mineradora a partir do olhar da Corte de Contas Nacional. Especificamente, buscou-se apresentar o histórico e os marcos regulatórios da atividade mineradora no Brasil; caracterizar a atuação do TCU nas atividades reguladas pela ANM a partir dos seus relatórios de auditoria e discutir as implicações dos encaminhamentos dos relatórios de auditoria realizados pelo TCU para o processo de accountability na atividade mineradora. Para a realização da pesquisa, buscou-se uma abordagem qualitativa com base na pesquisa bibliográfica e documental, tendo como atores, o TCU e ANM. Desta forma, este estudo buscou entender a atuação do TCU, a partir dos encaminhamentos dos Acórdãos exarados pela Corte de Contas. Acredita-se que ao apontar novas perspectivas para o desenvolvimento de accountability na administração pública do país, o estudo é fulcral para a administração pública nacional, com potencial de gerar importantes trabalhos que contribuam para a gestão pública de resultados, mas, principalmente, para o fortalecimento do Estado democrático de direito e da solidificação da democracia tupiniquim. In this work, the role of the Court of Audiotrs - TCU as an external control body for mining activities regulated by the ANM was analyzed, studying the Brazilian mineral sector, through the lens of horizontal accountability to understand the mining activity from the point of view of the National Court of Auditors. Specifically, we sought to present the history and regulatory frameworks of the mining activity in Brazil; to characterize the performance of the TCU in the activities regulated by the ANM from its audit reports and to discuss the implications of the referrals of the audit reports carried out by the TCU to the accountability process in mining activity. To carry out the research, a qualitative approach was sought based on bibliographic and documental research, having as actors, the TCU and ANM. In this way, this study sought to understand the performance of the TCU, based on the referrals of the Judgments issued by the Court of Auditors. It is believed that by pointing out new perspectives for the development of accountability in the country's public administration, the study is central to the national public administration, with the potential to generate important works that contribute to the public management of results, but mainly to the strengthening of the democratic rule of law and the solidification of Tupiniquim democracy.
