The separation of powers in presidentialist countries: Latin American in comparative perspective

Popis: Este artigo discute a separacao de poderes nos paises presidencialistas da America Latina, ressaltando seus pressupostos teoricos e evidenciando o balanco entre os poderes Executivo e Legislativo, bem como suas implicacoes para o aperfeicoamento democratico. Conclui que a maioria dos paises presidencialistas latino-americanos apresenta predominio do Legislativo com importantes casos desviantes, como Brasil, Chile e Mexico, onde ha ou conflito entre poderes ou predominio do Executivo. Abstract This article discusses the separation of powers in the presidentialist countries of Latin America, emphasizing their theoretical premises and looking at the balance of powers between the Executive and Legislative branches, as well as the implications that the latter has for the perfection of democracy. I come to the conclusion that in the majority of Latin American presidentialist countries the Legislative branch prevails, with important deviant cases such as Brazil, Chile and Mexico in which there has either been conflict between branches or prevalence of Executive powers. Resume Dans cet article il sera question de la separation des pouvoirs dans les pays de regime presidentiel en Amerique Latine. On soulignera la conformite aux presupposes theoriques et on mettra en evidence l'oscillation entre les pouvoirs executif et legislatif ainsi que ses implications concernant le perfectionnement democratique. En guise de conclusion, on montrera que dans la plupart de ces pays latino-americains le legislatif l'emporte. Parallelement on trouvera des cas deviants comme celui du Bresil, du Chili et du Mexique ou il existe des conflits des pouvoirs ou bien l'executif l'emporte.
