Popis: This chapter is a study of the Town of Oyster Bay versus Commander Oil, which was a case decided on riparian rights and was connected to environmental engineering and environmental law. The discussion here is of a hypothetical addition to that case. Although the position of Oyster Bay was that the issue in the case was simple—a dredging permit for the bay bottom was denied Commander Oil—the implications of the engineering standards involved are that Oyster Bay could have pursued a number of inquiries into the standards issues, which might have altered the outcome of the case. The Town of Oyster Bay missed the boat by not reviewing the environmental standards. The principal objective of this chapter is to use this case to demonstrate the breadth of potential usage of engineering standards.
