Abstrakt: | The article focuses on the England and Wales Court of Appeals cases of R. v. Dawes, R. v. Hatter, and R. v. Bowyer, wherein the Court considered the British Coroners and Justice Act 2009 to resolve problems arising from the loss of control defence. It informs that the Court dismissed appeals of the defendants D, H, and B, on the basis that when a person killed another person in a desire for revenge, he should not be convicted of murder, but of manslaughter. |
