Abstrakt: The article discusses the utility of Alien Tort Statute (ATS), the U.S. Alien Tort Claims Act, in helping foreign corporations to anticipate their U.S. litigation and regulatory enforcement risk. It cites the reference of the U.S. Supreme Court case Kiobel v. Royal Dutch Petroleum Co. in which the questions of corporate liability and extraterritorial jurisdiction were discussed. It mentions that if the decision will come in favor of Kiobel it would be welcomed by corporations.
