Abstrakt: With a requirement for a nuclear power regime in mind, this comment examines both national and international legal frameworks as they relate to the production of nuclear energy in France and Germany. Following an introduction, Part 2 of this comment provides an overview of the two contrasting nuclear energy regimes as they relate to each country's traditional organizational structure. Part 3 provides an analytic comparison of the legal frameworks associated with nuclear licensing and construction activities. Part 4 follows with a similar analysis focusing on activities related to the operation of nuclear facilities. In Part 5, a brief comparison outlines the limited development of French and German decommissioning frameworks. Finally, Part 6 discusses prospects for continued harmonization of the French and German nuclear regimes, proposing measures for the development of a model legal framework for nuclear activities.
