The overall development of any child is elevated when they are brought up in a family environment with love, care, and attention. Children with incarcerated parents are often raised in an unstable environment and are subject to various human rights violations; particularly, their right to education is compromised. As per the 27th edition of Prison Statistics India, the number of children living with incarcerated parents in Indian prisons stands at 1,8673. However, this number only accounts for the children allowed to reside in prison with the women prisoners, while the number of children with incarcerated parents living outside prison remains unknown. According to the National Policy for Children, children with incarcerated parents need enhanced care and protection4. This article analyzes the impact of parental incarceration on the educational rights of their children and various legal provisions and government policies on this matter. This article, which is based on a doctrinal research method using secondary data, has found that children with incarcerated parents face varying challenges in accessing their right to education and suggests that legal protection available to children, in general, must be extended to children with incarcerated parents.
