Abstrakt: The article focuses on the comparative analysis of labor laws in bankruptcy in the Netherlands, France, and Germany and the dominant approach to bankruptcy law in the U.S. Topics discussed include labor costs associated with rehabilitating distressed corporations, labor modifications reduce the level of employment protection in bankruptcy and procedural approach adopted by the U.S. Supreme Court in the case Butner v. United States related to the treatment of the substantive law in bankruptcy.
