| Abstrakt: |
The article presents information on the settlement of mass tort litigation and the emerging opt-in paradigm. The use of contractual agreement between the defendant and liaison counsel of the plaintiff, discovery and pretrial rulings are discussed. The principles related to of aggregate litigation as published by the American Law Institute, implementation of traditional settlements and the nature of unrepresented interests are also discussed. |
