The article reports on the significant role played by joint defense agreement (JDA) in addressing construction claims in the U.S. It presents a situation where the contractor alleges the design professional for defects in the construction project. It reveals that cooperation between the engineer and owner through JDA will help them to efficiently address claims from contractors as well as prevent litigation. |
