The article focuses on the latest evolutionary phase of criminal sentencing which is the return to determinate sentencing structures. The authors cite the concurrent application of sentencing guidelines and mandatory minimum statutes in various jurisdictions. They state the effects of distinct reforms and their attempts to remedy the deficiency by using federal sentencing data to isolate the effects of the minima from the guidelines. The authors assess how the predictors and conditioners of sentencing outcomes vary between them. |
