Artisanal and small-scale mining in Indonesia: Towards sustainable practices through regulatory system implementation.

Abstrakt: Indonesia has a long history of Artisanal and Small-Scale Mining (ASM) practices followed by the regulatory system. In the Indonesian regulatory system, ASM is known as Pertambangan Rakyat (Community Mining). The implementation of regulation related to ASM facing enormous challenges and needs to be evaluated for better practices. This study will highlight the change in the recent Mining Law (UU No 3/2020) as updated UU No 4/2009. In the UU No 3/2020, administration and technical requirements are mentioned and should be followed with derivative regulations. The focus of this study is related to the retribution system and monitoring and evaluation of ASM practices. The retribution system called Iuran Pertambangan Rakyat (Ipera) adopts medium and large-scale mining operations retribution towards the Provincial government. The methodology of this research is mixed with qualitative and quantitative. The qualitative methods used to assess the implementation of the UU No3/2020 and knowledge gap through cross-country comparative study. The quantitative methods used in unit cost formulation of IPERA through a case study. This study will be used for improving current regulation and tackling challenges in the regulatory system implementation. [ABSTRACT FROM AUTHOR]
