Abstrakt: The article examines the federal compensatory mitigation regulation issued by the Army Corps of Engineers and Environmental Protection Agency (EPA) in April 2008 in the U.S. The author examines the regulation on how it addresses recommendations concerning the watershed approach, operational guidelines and performance standards, and the treatment of mitigation banks. In addition, the regulation also discusses watershed scale. It is explained that the promise of the new regulation in accomplishing no-net-loss will depend on the view of the Corps on regulatory provisions as discretionary or obligatory.
